CodeGravity s.r.o. (referred to as "we", "us", "ExtraWatch", "CodeGravity" or "Company") is a software development company. Our Company provides software download and support services for a fee, collectively called "subscriptions". All of our services are provided through the web site https://www.extrawatch.com, hereforth called "the Site" or "our site".

CodeGravity s.r.o. is a limited company registered in the Slovak Republic with the purpose of providing software and services related to it.

1. Acceptance of the software license

By downloading and/or installing our software on any site you explicitly agree to the terms of its license, GNU General Public License version 3 or, at your choice, any later version published by the Free Software Foundation. A copy of the license is included with our software. 

 

2. No Warranty

Our services are provided as-is, without any warranty whatsoever. The exact terms of our software license can be read by following the "License" link at the bottom of any page of extrawatch.com. Regarding the support services, we can not guarantee the validity or veracity of any provided information or suggestion.

THE SERVICES ARE PROVIDED AS-IS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTY OF AVAILABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE AVAILABILITY, QUALITY AND PERFORMANCE OF OUR SERVICES IS WITH YOU. SHOULD ANY OF OUR SERVICES PROVE INEFFICIENT OR UNSUITABLE, YOU ASSUME THE COST OF ALL NECESSARY ACTIONS TO RECTIFY THE ISSUE.

IN NO EVENT UNLESS REQUIRED BY APPLICABLE LAW CODEGRAVITY S.R.O., ITS OWNERS, STAFF, ASSOCIATES OR ANYONE AFFILIATED WITH ITS MAINTENANCE, OPERATION OR HOSTING BE LIABLE TO YOU FOR DAMAGES, INCLUDING ANY GENERAL, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE SERVICES (INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR DATA BEING RENDERED INACCURATE OR LOSSES SUSTAINED BY YOU OR THIRD PARTIES OR A FAILURE OF OUR PROGRAMS TO OPERATE WITH ANY OTHER PROGRAMS), EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Should the applicable law hold CodeGravity s.r.o., its owners or any party affiliated with it liable for damages, the maximum amount of damages acknowledged shall be no higher than 5 Euros. Shall any dispute arise between CodeGravity s.r.o. and a third party, the only applicable jurisdiction is the Courts of Law of Slovak Republic.

If you do not agree with these Terms, you are not allowed to use our services. Moreover, any use of our services implies the unconditional and immediate acceptance of the aforementioned terms, waiving your legal rights to uphold them. Acting in violation of these Terms of Service immediately terminates the business relationship between you and CodeGravity s.r.o.

 

3. Consent

When using our software, you are responsible for requesting and storing user's consent. This includes consent required by the EU GDPR regulation and all other consents required by the applicable laws and regulations.

According to EU GDPR regulation and other applicable laws and regulations, you must be able to prove this consent given by user of your website. 

You are responsible for modifications in a way that the end user shall not use our services when the consent has not been given by the user.

You must modify your privacy policy, cookie policy page and document that you use this software and type of information which it stores there.

 

4. Age restriction 

The minimum age to use ExtraWatch services is 16 years old

 

5. Scope of provided services

5.1. Support period

When user buys the software license, can get support defined below for 6 months. Customers can renew the license from customer zone if support period is over from customer zone for another 6 months. 

5.2. Type of support services provided

ExtraWatch staff might help users in cases when:

- it is not possible to install and use extension

- it is not possible to activate the extension 

5.3. Type of support services which is not provided

ExtraWatch staff reserves a right not to solve problems, which are related to:

- installation and activation the extension on behalf of the customer

- a software bug, which is does not block user from using the extension

- resolving potential clashes with other extensions and their settings, versions of CMS / PHP / MySQL

- answering request for potential software modifications  

- changes to templates / styles used by the customer

- root cause lies in the server configuration

- older versions of the CMS / PHP stack / our extension

- when you have modified the original code

  

6. Requesting support

The only official way to request a support is via: 

  • Private Support Ticket

We do not provide any guarantee on answering requests sent via email or other communication channel. 

 

6.1 Private Support Tickets 

When user submits support ticket, he should choose the correct category. Creating ticket in wrong category might make the process of solving the problem longer.  

 

6.1.1.1. Licensing Support

This has the highest priority and is solved on first place. Whenever user has some problem that he cannot login to customer download zone or other kind of problem related to payment and access to the latest version of the software.

 


6.1.1.3. Temporary Passwords

We might ask users to create temporary admin access and FTP access in order to check the problem directly on their site. In that case user MUST use custom fields at the bottom of the ticket.

Users should NEVER paste passwords into the text of the ticket. After the ticket is solved and closed, user must change the password immediately. We reserve right not to take any responsibility if user did not change the password.

 

6.1.2. Software Defects Support

If user finds software defect, he should submit a support ticket with short description about the problem and steps how it's possible to reproduce the problem.

We're trying to do our best to have software bug-free, but fixing some bugs might take some time. Sometimes it might be days or even weeks. We reserve right to fix found bugs according to our own time schedule

 

6.1.3. Public Support Forum Posts

We do not answer public forum posts, private tickets have to be used instead.

8. Account termination policy

If the content you submit to extrawatch.com is deemed offensive, inappropriate, defamatory, objectionable or in any other way engage in disruptive behaviour we reserve the right to use your personal information to stop such behaviour.

If CodeGravity s.r.o. believes on reasonable grounds that you are in violation of the laws of the Slovak Republic, or the European Union directives, we reserve the right to submit your personal information - including the content itself and any other relevant information about you - to the proper authorities, such as law enforcement, your ISP or school email / ISP.

CodeGravity s.r.o. reserves the right to terminate user accounts (free or paid subscribers) when the aforementioned fair use rules are violated. Furthermore, CodeGravity s.r.o. reserves the right to terminate user accounts if the user is posting unsolicited messages (spam), engaged in sites or services promoting the unauthorised distribution of proprietary or other distributed for-a-fee software (warez), directly promoting or linking to resources promoting indecent or unlawful actions, or in any other way trying to disrupt or diminish the quality of the services offered by this site. Account termination takes place without prior notice and is considered final.

Holders of terminated accounts, if they are paid subscribers, will not be refunded. CodeGravity s.r.o. reserves the right to terminate any further user accounts created by the holder of a terminated account, or any other person, business or organisation affiliated with or endorsed by the holder of a terminated account.

 

9. Updates to our Terms of Service

We reserve the right to add, remove or modify any section, article or paragraph of our Terms of Service and Privacy Policy without prior notice. The date at the top of the document will be updated to the last modification date. All changes are effective immediately. We strongly recommend that you read this page periodically to stay up to date with our terms of service.
